1. Licence

Steady EQ is an equalizer. The app is licensed, not sold, to you. We grant you a personal, non-exclusive, non-transferable licence to install and use the app on devices you own or control, for personal, non-commercial use. You may not copy (except as Google Play allows), modify, reverse-engineer, resell, sublicense, or redistribute the app, except where applicable law expressly permits it.

The app, this website, the Steady EQ name, logo, and design remain our property or that of our licensors.

2. Eligibility

You must be at least 16 years old to use the app, or have the consent of a parent or legal guardian.

3. How the equalizer works, and its limits

Steady EQ works through Android's audio effect framework. What it can reach depends on your device, your Android version, your manufacturer's software, and on each app: some apps never announce their audio, and browser audio and protected video cannot be changed by any equalizer app. Android or your device manufacturer may also stop, restrict, or delay the app in the background — for example through battery optimisation, a system update, or a restart — and another equalizer or audio app may take over the audio effects.

Steady EQ watches for these cases and tells you about them, but we do not guarantee that every app will be reached at all times. The compatibility information, status, and listening estimate in the app are estimates based on what Android reports and on typical headphones.

4. Steady EQ Pro

The equalizer is free to use. Some features are part of Steady EQ Pro, a one-time in-app purchase — not a subscription. The price is shown in the app before you buy. Purchases are processed by Google Play under Google's terms, including its refund policies; your statutory rights remain unaffected.

Pro is tied to the Google account you bought it with and can be restored on other devices using that account. If we ever offer a subscription, a Pro purchase you have made stays valid.

5. Your data

Your presets, devices, and settings are stored on your device. There is no account and no sync to our servers; see our Privacy Policy. Because we never receive this data, we cannot recover it if you uninstall the app or clear its storage. You can keep a copy with the app's backup file or Android's own backup.

6. Acceptable use

Do not use the app or website to violate any law, and do not try to disrupt, or gain unauthorised access to, the app, the website, or our systems.

7. Protect your hearing

Boosting frequencies makes audio louder. Listen at moderate volume, and lower it if you notice ringing or discomfort. The listening estimate in the app is a rough guide for typical earbuds, not a measurement of your actual exposure.

Personal sound adjusts your sound to your taste. It is not a hearing test, does not provide medical advice, and cannot tell you anything about your hearing or your health. If you have concerns about your hearing, please see a qualified professional.

8. Warranty and liability

If you are a consumer, your statutory warranty rights for digital products apply.

We are liable without limitation for damage caused intentionally or through gross negligence, for injury to life, body, or health, under the German Product Liability Act (Produkthaftungsgesetz), and where we have given a guarantee. For slight negligence, we are liable only if we breach an essential contractual obligation, meaning one that must be fulfilled for the contract to be properly performed and that you can regularly rely on. In that case, our liability is limited to the damage that is foreseeable and typical for this type of contract. Otherwise, we are not liable for slight negligence.

9. Changes to the app and these terms

We may update the app to fix bugs, improve features, or comply with legal and store requirements.

We may update these terms, for example when features or legal requirements change. Changes apply from the date shown under "Last updated". If a change materially affects you, we will tell you in the app or on this website before it takes effect.

You can stop using the app at any time by uninstalling it. If we discontinue the app, we will give reasonable notice where possible.

10. Governing law and disputes

These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of the country where you habitually reside.

If you are a merchant (Kaufmann), a legal entity under public law, or have no general place of jurisdiction in Germany, the courts of Berlin, Germany have exclusive jurisdiction. Consumers may bring proceedings in the courts that have jurisdiction under the law.

We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle).
